Summary: This article aims to analyze the evolution of the Social State to the new Socio-Environmental State of Law model seeking to manage the risk society. Its overall goal is to answer if the current Social State is characterized as a State Environmental Law, studying, therefore, the Theory of the State, formulated by Hermann Heller, which highlights the state Social Law. The methodology was used in inductive research phase. The article was produced by techniques of the referent, the category of operational concepts, the literature search and cataloging.
