Jurisdiction administrative dispute, due to the influence of the Inter-American Court of human rights, has in recent years adopted measures of reparation of the damage in itself considered as opposed to the consequence damage, especially when there has been a breach to the human rights of the plaintiffs; in several judgments of the Council of State ordering the adoption of restorative justice measures to repair in natura to the victims. However, the Court confuses sometimes damage event with the damage result and in our environment, only progress in the objective of the event damage repair when there has been an infringement of the right to health, being budding construction of objective criteria of compensation or repair when other conventional or constitutional rights are violated.

However, the Court confuses sometimes damage event with the damage result and in our environment, only progress in the objective of the event damage repair when there has been an infringement of the right to health, being budding construction of objective criteria of compensation or repair when other conventional or constitutional rights are violated.La juridiction contentieuse, grâce à l’influence de la Cour Interaméricaine des Droits de l’Homme, a pris des mesures ces dernières années pour réparer les dégâts constatés, par opposition aux dommages causés, surtout quand il y a eu une violation des droits de l’homme; ceci est démontré par plusieurs sentences du Conseil d’État rendant obligatoire l’adoption de mesures de justice réparatrice pour réparer en nature aux victimes. Toutefois, la Cour, confond parfois le “dommage événement” avec le “dommage conséquence” et dans notre environnement,nous avons seulement avancé dans la réparation objective du “dommage événement” quand il y a une violation du droit à la santé et qu’il reste une préparation de la construction de critères objectifs d’indemnisation ou de réparation lorsque les autres droits constitutionnels sont violés.A jurisdição contencioso administrativa, graças à influência da Corte Interamericana de Direitos Humanos, tem tomado medidas nos últimos anos acerca da reparação do dano em si mesma considerado em contraposição ao dano consequência, especialmente quando tem havido uma vulneração pelos direitos humanos dos demandantes; isto evidenciase em várias sentenças do Conselho do Estado que ordenam a adopção de medidas de justiça reparatória para restaurar in natura às vítimas. Porém, a Corte confunde, em ocasiões, o dano evento com o dano  onsequência e em nosso meio, só se tem avançado na reparação objetiva do dano evento quando tem havido uma vulneração do direito à saúde e fica em andamento a construção de critérios objetivos de indemnização ou reparação quando vulnerarem outros direitos constitucionais ou convencionais.La jurisdicción contencioso administrativa, gracias a la influencia de la Corte Interamericana de Derechos Humanos, ha adoptado medidas en los últimos años sobre reparación del daño en sí mismo considerado en contraposición al daño consecuencia, especialmente cuando ha habido una vulneración a los derechos humanos de los demandantes; ello se evidencia en varias sentencias del Consejo de Estado que ordenan la adopción de medidas de justicia restaurativa para reparar in natura a las víctimas.
