The Act number 8/2013 on urban rehabilitation, regeneration and renewal incorporates new duties, not only regarding the reparing and prevention of the building deterioration (the improving of building’s maintenance), but also duties for improvement of buildings as well as the obligation to participate in urban regeneration. In addition, the Act empowers the Administration to concretise these duties at its discretion. This imposition of new duties, based on some parameters that are currently inconsistent, can lead to a breach of the constitutional rule on arbitrariness prohibition.Los contenidos del deber de conservación mantienen desde hace veinte años un crecimiento constante, tanto en sus límites cuantitativos como en sus contenidos, incorporando con la Ley 8/2013, de 26 de junio, de rehabilitación, regeneración y renovación urbanas, unos deberes que van más allá de la reparación del edificio o de la prevención de su deterioro, abancando la mejora y adaptación del edificio e incorporando el deber de participación en la regeneración urbana. Deberes que en gran medida quedan a la determinación discrecional de la Administración urbanística.
