Summary: During the last twenty years, the duty regarding conservation of buildings has regularly increased. The Act number 8/2013 on urban rehabilitation, regeneration and renewal incorporates new duties, not only regarding the reparing and prevention of the building deterioration (the improving of building’s maintenance), but also duties for improvement of buildings as well as the obligation to participate in urban regeneration. In addition, the Act empowers the Administration to concretise these duties at its discretion. This imposition of new duties, based on some parameters that are currently inconsistent, can lead to a breach of the constitutional rule on arbitrariness prohibition.
