To accomplish this objective, this work looks at the institutional design that spurred the 1991 Constitution, which removed television as a public service as well as the state authority in charge of its regulation. This piece then studies the scope of statutes, laws and regulations that were issued following the 2011 Constitutional reform, which distributed the work of Colombia’s now extinct National Television Commission to different entities, such as the recently created National Television Authority.Con el presente artículo se pretende identificar si la Autoridad Nacional de Televisión es o no una agencia estatal independiente del ejecutivo y si cuenta con las garantías institucionales de independencia para el ejercicio de sus funciones. Para lograr este cometido se revisó el diseño institucional que inspiró la reforma a la Constitución de 1991, que suprimió el carácter constitucional que ostentaban en Colombia tanto el servicio público de televisión como el órgano encargado de su regulación.
