To execute this task, first it’s necessary to study the legal status of freedom of expression in Brazil. Further, it seeks to examine the racial hate speech, in the specific case of White Power bands, presents itself as a limitation on freedom of expression in current national Constitutional Law. The method of approach used is deductive. The research is qualitative, technical literature and prescriptive, with the use of books, journal articles, dissertations, theses relevant, jurisprudence and legislation.Este estudo pretende analisar se o discurso do ódio racial, no caso das bandas White Power – bandas ainda atuantes, e que cantam ideais de superioridade racial branca e de estigmatização a negros, judeus e nordestinos, etc. –, constitui uma limitação à liberdade de expressão no País, e se, portanto, deve ser restringido. Para a execução da tarefa que se propõe, primeiro se estuda o estatuto jurídico da liberdade de expressão no Brasil. Na sequência, procura-se examinar se o discurso do ódio racial, no específico caso das bandas White Power, apresenta-se como uma limitação à liberdade de expressão, em face do ordenamento jurídico constitucional pátrio vigente. O método de abordagem utilizado é o dedutivo.
