From the study of historical and theoretical elements of revolution and, in more detail, the French Revolution, we intend to demonstrate the importance of the idea of discontinuity to the genesis of Law in the Modern Age. With the new model of Law, the concept of legal certainty would be put as the key to demand both a normative and institutional setting as well as a structural thinking in order to support it. Under the sign of legal positivism, the primacy given to the formal foundations of the system completed by ensuring the dialectic of continuity and discontinuity, paving the way for the dramatic phenomena occurred during the Second World War. Since then, a broad movement has been trying to rethink the law in order to rescue the new dimensions of legal rationality. We will also try to investigate how this movement, known as postpositivism, can contribute to a new understanding of the dialectic between continuity and rupture in the Modern Law. Key words: continuity, rupture, revolution, French Revolution, Modern Law, rationality, legal certainty.O presente artigo pretende realizar uma análise de como os vetores da continuidade e da ruptura têm marcado a conformação e a estrutura do Direito Moderno. A partir de um estudo de elementos teóricos e históricos do fenômeno revolucionário e, mais detidamente, da Revolução Francesa, pretendemos demonstrar a importância da ideia de ruptura para a gênese do Direito na Modernidade. Com a implementação deste novo Direito, o conceito de segurança jurídica colocar-se-ia como elemento central a demandar tanto uma configuração normativo-institucional quanto um pensar estruturante que lhe desse respaldo. Sob o signo do positivismo, a supremacia conferida aos fundamentos formais do sistema terminou por velar a dialética entre continuidade e descontinuidade, abrindo caminho para os fenômenos ocorridos durante o período entreguerras. A partir desse momento, constatou-se um amplo movimento visando repensar o Direito e buscando o resgate de novas dimensões da racionalidade jurídica. Investigamos, então, como esse movimento, alcunhado de pós-positivismo, pode contribuir para uma nova compreensão da dialética entre a continuidade e a ruptura no Direito.
