Summary: The juridical regulation of the life and death must accompany to the scientific advances and the cultural changes. This relationship has suffered important alterations in the last decades. The constitutions have also accused the impact. The Spanish Constitution of 1978, and the rest of the juridical regulation, is experiencing serious difficulties in this aspect. The speed of the changes suggests readjustments and revisions. The fundamental rights of the article 15, among others, begin to propose more appropriate and according interpretations to the new framework. All these factors have dilated the space of the legislator, who has to confront the new challenges.
