Recurso de casación, incumplimiento por el comprador del contrato de compraventa del inmueble: comentario a la STS (Sala de lo civil) 705/2013, de 12 de noviembre (Rj 2013, 7866)

The lack of payment or breach of contract excludes the default and produces a final non-fulfilment because the creditor�s interest becomes frustrated. For that there is a novation, either with amending or extinctive effects of the originative obligation, the agreement of the parties is required.
