We currently have two models of international conventions to avoid double taxation: the United Nations Model Tax Convention and the Organization for Economic Co-operation Development Model Tax Convention. These models are the most important international guidelines that follow States at the time of signing their double taxation conventions. These convention models do not define how to tax income and capital but the distribution of fiscal power of the Contracting States to neutralize the harmful effects of international double taxation. While the content of theses convention models is a guide for States (not binding), its provisions are also usually taken in the double taxation conventions, so any change in its content may have repercussions on the bilateral subscribing States. Business profits (art. 7) are among the different that regulate the models conventions and the double taxation conventions, whose treatment was changed in the OECD Model Tax Convention in late 2010 and whose impact we analyze in the next points. More precisely, this paper has two main objectives: firstly, we will work to develop the current tax treatment of business profits in the OECD Model Tax Convention; and secondly, we will determine the potential impact that the new wording may lead to the Double Taxation Conventions signed by the Federal Republic of Brazil. Specifically, on July 22, 2010 were published the final update of the OECD Model Tax Convention 2010 and, finally, on September 13, 2010 was published the consolidated version of the new Model. Whilst Article 7 was the only one reformed (business profits) this was not the only modification of the new Model, and also reviewed the comments of most of the articles. Historically, within the binomial developed countries and developing countries, the Federal Republic of Brazil can be considered as a developing country, therefore would be theoretically more protected by the UN Model Tax Convention. Nevertheless, if we compare the provisions of the OECD Model Tax Convention and the UN Model Tax Convention we can say that Double Taxation Conventions signed by the Federal Republic of Brazil are based on the wording of Article 7 of the first one (without regard to its latest version of 2010). From this we can see that the OECD Model Tax Convention has an important influence on the bilateral convention concluded by the Federal Republic of Brazil. So this new amendment to its Article 7 is not indifferent to that country and for its network of double tax conventions.

Son las dos guías internacionales más importantes que siguen, en mayor o en menor medida, los Estados a la hora de suscribir sus convenios de doble imposición. Estos modelos de convenios no definen cómo se han de gravar la renta y el patrimonio sino que se limitan a distribuir la potestad tributaria de los Estados contratantes para neutralizar los efectos perjudiciales de la doble imposición internacional. Si bien es cierto que el contenido de estos modelos es una mera guía para los Estados (no tiene carácter vinculante), sus disposiciones también son normalmente adoptadas en los Convenios de Doble Imposición, así que cualquier modificación en su contenido puede llegar a repercutir en los Convenios bilaterales que suscriban los Estados. Entre las diferentes rentas que regulan los modelos de convenios y convenios bilaterales encontramos los beneficios empresariales (art. 7), cuyo tratamiento se modificó en el Modelo de Convenio de la OCDE a finales de 2010 y cuyas repercusiones pretendemos analizar en los próximos puntos. En términos más precisos, el presente trabajo persigue dos grandes objetivos: por un lado, nos dedicaremos a desarrollar el tratamiento fiscal que el actual Modelo de Convenio de la Organización para la Cooperación y el Desarrollo Económico le dispensa a los beneficios empresariales y, por el otro, determinaremos las posibles repercusiones que la nueva redacción puede acarrear a los Convenios de Doble Imposición suscritos por la República Federal de Brasil. Concretamente, el 22 de julio de 2010 se publicaron las actualizaciones definitivas del Modelo de Convenio de la OCDE 2010 y, finalmente, el 13 de septiembre de 2010 se hizo pública la versión consolidada y definitiva del nuevo Modelo. Si bien es cierto que el único artículo que se reformó fue el número 7, referido a los beneficios empresariales, ésta no fue la única modificación del nuevo Modelo, ya que también se revisaron los comentarios de gran parte del articulado. Históricamente, dentro del binomio países desarrollados y países en vías de desarrollo, la República Federal de Brasil puede considerarse como un país en vías de desarrollo, en consecuencia, estaría teóricamente más arropado por el Modelo de la ONU. No obstante ello, si comparamos las disposiciones del Modelo de la OCDE y de la ONU, podemos decir que los CDI suscritos por la República Federal de Brasil se basan en el texto del artículo 7 del primero de ellos (sin tener en cuenta su última versión de 2010). A partir de ello, podemos ver que el Modelo de Convenio de la OCDE ejerce una importante influencia en los convenios bilaterales suscritos por la República Federal de Brasil.
