Summary: It analyzes, in the nowadays Brazil´s class actions civil procedure system, the admissibility of a class action be sued against an organized group, facing the problem of a clear rule prevision inexistence, the judiciary control over the adequacy of representation possibility and also the subjective extension of the claim preclusion efects, the main theorical fundaments for the admissibility of what the doctrine begins to name as passive colective action. Confronting the divergent interpretations about this subject, analisyng the nowadays laws and consulting courts decisions about the main presented points, it will not only analyze the proposed questions but also give an image about the present and future position of the brazilian law concerning this especie of class action.
