This study analyzes the criteria of attribution according to which to the State is attributed a role, which in turn is used to empower entities to exercise elements of government authority, applying attribution rationale to cases where the State acts through private entities to develop their own functions. After an explanation of this phenomenon itself, and its relations with the role of mercenary, we will review the existing primary rules as well as private and public attempts to regulate this phenomenon. On the basis of this the attribution of conduct of these private entities the State will be analyzed and solutions regarding international State responsibility will be offeredAnte el fenómeno de la privatización de funciones estatales se plantean múltiples interrogantes en relación con la responsabilidad de los actores implicados. En este estudio se analiza el criterio de atribución conforme al cual al Estado se le atribuye el comportamiento de entidades facultadas para ejercer atribuciones del poder público, al considerar que es este fundamento de atribución el aplicable a los supuestos en los que el Estado actúa a través de entidades privadas para desarrollar sus propias funciones. Tras una referencia al fenómeno en sí mismo, así como a sus relaciones con la figura del mercenario, se hace un repaso a las normas primarias existentes y los intentos privados e institucionalizados de regular el fenómeno.
