Who should define public policy? This query reveals the need for establish non-recognized rights, apparently illegitimate ones that require becoming the legal framework and will have to operate in parallel to all the general rights. Thus, the right to demand rights and the non-legalized ones are exemplified with the differentiated rights. The proposal is that these rights should be promoted the platforms of the new electronic technologies.La representatividad de los poderes legislativo y ejecutivo da legitimidad a la Democracia. Pero en ocasiones los electores son ignorados por sus representantes políticos y los resultados negativos de las políticas públicas cuestionan la capacidad y honradez de los gobernantes; particularmente cuando éstas han sido incompletas de cara a grupos minoritarios o en opresión. ¿Quién debe entonces definir las políticas públicas? Este interrogante devela la necesidad de establecer derechos no reconocidos, derechos aparentemente ilegítimos que requieren devenir al marco legal y tendrán que operar paralelamente al conjunto de derechos generales. Así, el derecho a exigir derechos y los derechos todavía no legalizados, se ejemplifican con los derechos diferenciados.
