Additionally, the American States are bound by the Interamerican Convention on International Commercial Arbitration subscribed in Panama City in 1975. However, this document has been criticized concerning its content and its execution possibility; for this reason, its efficacy and application have been set aside by transnational commerce operators for solving controversies. In effect, its arbitrability requirements are not very clear, so its existence should be specified in such a way that the Convention can be recognized as a real juridical consolidation tool for solving controversies in an amicable way.Desde una perspectiva internacional, la disciplina jurídica que dispone de los instrumentos más difundidos en el mundo para garantizar su efectividad probablemente es el arbitraje comercial. Dentro de tales instrumentos se destaca la Convención de Nueva York de 1958. Adicionalmente, los Estados americanos cuentan con la Convención Interamericana de Arbitraje Comercial Internacional, suscrita en Ciudad de Panamá en 1975. Sin embargo, este documento ha sido objeto de críticas en cuanto a su contenido y posibilidad de ejecución, lo que ha ocasionado que su eficacia y aplicación hayan sido dejadas de lado por parte de los operadores del comercio transnacional para la solución de controversias.
