Of course, we start from the premise that such a situation provides the Constitution of each State, a provision which in turn must respect the common legislator. However, the issue is not entirely peaceful, mainly due to the struggle for power between the central thesis and decentralization as contemporary doctrine and related to any State Social and Democratic, for instance, the Costa Rican. Thus, this study begins with a brief comparison with the Republic of Chile, which by the way, keeps even today, some remains, of course unfortunate, of the dictatorship of Pinochet disappeared. This, coupled with the central thesis has penetrated deeply into the legal system of the South American country.
