Summary: The article offers elements for a critical analysis of Transitional Justice´s processes based on the advantages and disadvantages of this model law, and the lessons to be learned from its application in different historical contexts. It explores the concepts of retributive justice and restorative justice in order to understand what changes occur in the notions of crime, punishment and offense-sentence in exceptional contexts and what are the implications of reconfiguration for the sake of peace. In Comparative Perspective examines the experiences in South Africa, Central America and Colombia to show that there is no ideal archetype of transitional justice, and therefore, the mere implementation of this legal formula is insufficient to achieve the societal transformation required in countries affected by violence.
