From birth, the individual is classified as female or male, a condition that will follow him/her through the rest of his/her legal life. Intersex and transgender cases show the violence of these mandatory assignments and show the difficulties they have in finding a term that addresses the subjective gender and law. Based on a study of French civil law, this article critically reviews gender assignment and the heterosexual matrix in the law to propose an end of the category �sex� on birth certificates. According to the author, sex, along with race, class, or profession, does not work as a defining element of the subject of law.A lógica binária dos sexos, apesar de não ser muito explícita, aparece como suporte do sistema jurídico no que diz respeito aos direitos das pessoas e da família. A partir do nascimento, o indivíduo é classificado como feminino ou masculino, condição que o acompanhará pelo resto de sua vida jurídica. Os casos dos intersexuais e dos transexuais evidenciam a violência das atribuições obrigatórias e mostram as dificuldades pelas quais passam essas pessoas para encontrar um termo que atenda ao sexo subjetivo e ao jurídico. Com base em um estudo do direito civil francês, neste artigo são analisadas, de maneira crítica, a atribuição de gênero e a matriz heterossexual da lei para propor o fim da categoria �sexo� nas certidões de nascimento.
