Summary: Affirmative action in contractual relations is a study that aims to demonstrate that the parties can add solutions to economic and social environment in which contractual obligations will be developed. This article is based mainly on the work of Joachim B. Barbosa Gomes, who made an analysis on the measures adopted in the United States to contain the spread of social inequalities, as well as provide access to the underprivileged classes of the opportunities that you were not accessible by the disparity created by capitalism. Giving a bias to the alternative approach of this work, the study will address a practical application of affirmative actions to ensure greater participation of private interests in the reduction of social inequalities, as well as the business aspect, where micro and small enterprises are constantly plagued by the interests of large industrial oligopolies. New forms of contractual interpretation, and some proposals for affirmative action that can be applied to contracts will also be inserted in this context.
