Starting with an analysis of opinion, the article intends to demonstrate the tragical nature of democracy: on the one side, it cannot dispense with truth; on the other it cannot be safe of being in truth.El objeto de este trabajo es intentar una justificación epistemológica tanto de la democracia como de la jurisdicción constitucional de los tribunales o cortes constitucionales (el guardián de la Constitución), examinando el modo peculiar en el que la verdad se manifiesta en los juicios políticos: como opinión.
