In this regard, the Treaty of Lisbon, states (art. 3 TUE): «The Union shall establish an internal market» and «It shall work for the sustainable development of Europe based on balanced economic growth and price stability, a highly competitive social market economy, aiming at full employment and social progress, and a high level of protection and improvement of the quality of the environment. It shall promote scientific and technological advance». If we add all the purposes which derive from the principle of subsidiarity, such as: «an economic, social and territorial cohesion, and solidarity among Member States» and the fight against «social exclusion and discrimination», «social justice and protection, equality between women and men» and «solidarity between generations», we can deduce that the primary purposes of the Union do not have an economic character, as before, but rather that the Union seems to have a «program» similar to that of states. To this regard, the author emphasizes the meaning and importance of reflection by Peter Häberle and his theory of constitutional law as «Science of Culture» with regard to an European Economic Constitution in order to develop a new concept of market in the juridical sense. From this theoretical perspective, the Constitutional State should be founded on the primacy of the constitution, considered, not only as a normative act of the State, but the base of the system and as the result of open and dynamic dialectical processes, hence the crisis of a mechanistic conception of constituent power.
