To this end, the author develops a systematic analysis of the protection of fundamental rights from a multilevel and comparative perspective. The objects of this study are the following sources: the European Constitutional Law, after the modifications of the Treaty of Lisbon, that includes the Charter of Fundamental Rights in the European Union (CFREU) and states the adhesion to the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR), the conventional-international Law, with special attention to the ECHR, the national declinations of this constitutionalism and the constitutional traditions of the peoples of Europe, that, through the jurisprudential reformulation of the European Union Court of Justice, have assumed the value of general principles of Law. The purpose is to contribute to the institution of a European Constitutional Law of the judicial power/order concerning the general principles of this, a fair trial and thus of a real European system of protection of fundamental rights.
