It will seek an approach to the establishment of the modern courts from reviewing the history of the Nuremberg and Tokyo tribunals, as well as AD HOC tribunals established for the former old Yugoslavia, Rwanda, Sierra Leone and Cambodia, which constitute the immediate background of the Rome Statute and the advent of the International Criminal Court.Tanto la Primera como la Segunda Guerra Mun dial, evidenciaron la necesidad de crear nor mas de carácter internacional que regularan una serie de garantías mínimas dentro de los enfrentamientos bélicos en pro del respeto de la dignidad del ser humano. Igualmente dio paso a la creación de Tribunales con el fin de investigar y declarar la responsabilidad penal individual por la ejecución de crímenes reprochables a nivel internacional. Se intentará un acercamiento al establecimiento de los tribunales modernos, desde la revisión de los antecedentes de los Tribunales de Nuremberg y Tokio, asi como los Tribunales Ad Hoc creados para la antigua Yugoslavia; Ruanda, Sierra Leona y Camboya, que constituyen los antecedentes inmediatos del Estatuto de Roma y del advenimiento de la Corte Penal Internacional.Universidad Militar Nueva Granada2009text (article)application/pdfhttps://dialnet.unirioja.es/servlet/oaiart?codigo=3401837(Revista) ISSN 0121-182XRevista Prolegómenos.
