It was established an unitary State but with autonomy for the territorial entities in political, administrative and financial matters. With regard to the pieces that make up the territorial organization, in addition to the preexisting entities (departments, municipalities and districts), were created some news, as the Indian territorial entities, and the Legislator was authorized to establish provinces and regions. It is important to point out the fact that the Constitution of 1991 left into the hands of the Legislator the power to define, specify and close the territorial model, according to the constitutional commands. Moreover, it must be recognized the role that the jurisprudence of the Constitutional Court has played in the definition of the structure of the territorial system, even though in many times its decisions has decline the autonomy of the territorial entities in favor of the principle of unity.Con la aprobación de la nueva Constitución, en 1991, los constituyentes lucharon por atacar el excesivo centralismo presente en el régimen constitucional anterior. Así, apostaron por un Estado unitario pero con autonomía política, administrativa y financiera para sus entes territoriales. En relación con las piezas que conformarían el conjunto de la organización territorial, es decir, las entidades territoriales, los constituyentes introdujeron varias modificaciones a la Constitución anterior, creando como entidades territoriales los departamentos, los municipios, los distritos y las entidades territoriales indígenas, dejando abierta la posibilidad para que una vez creadas las provincias y las regiones éstas también puedan adquirir dicho estatus. Cabe resaltar que a partir de la Constitución de 1991 la potestad para definir, concretar y cerrar nuestro modelo territorial quedó en manos del legislador, que es el encargado de desarrollar los mandatos constitucionales en esta materia.
