Several legal interpretation methods currently accepted are used for this purpose: literal or grammatical, systematic, historical, and teleological. Use of these four methods makes us conclude that such Law dealt with interruption of prescription and expiration and not with suspension, as it was erroneously expressed in it. Effects of this interpretation are important because interruption implies that the term for operation of prescription or expiration of judicial action starts again after conciliation request is submitted, which has an effect on the basic right of the person involved to have access to Justice Administration.Este artículo propone un esquema de interpretación del artículo 21 de la ley 640 de 2001, que trata los efectos de la presentación de la solicitud de conciliación, frente al fenómeno de la prescripción y la caducidad de la eventual acción judicial que se quiera plantear ante la posibilidad de que no se logre un acuerdo dentro del trámite conciliatorio. En este esfuerzo se utilizan los diferentes métodos de interpretación legales hoy aceptados, denominados: literal o gramatical, sistemático, histórico y teleológico o finalista. La utilización de estos cuatro métodos conduce a la conclusión de que la citada norma se refirió a la interrupción de la prescripción y la caducidad, y no a la suspensión como erradamente se expresa en la misma.
