AB  - The teleological character of the document of reflection centres on the characterization of the exception of unconstitutionality and its applicability on the
public servants of the administrative function, in altars of which when manifest
incompatibility of a norm exists opposite to the Constitution, the servant
assumes not only his duty but his constitutional obligation not to allow the
application of the norm with minor hierarchy.
The article looks for to think about the behavior and knowledge of the public
servants in front to the exception of unconstitutionality, thinking that the civil
servants have a minimal application of the exception of unconstitutionality,
there is understood therefore, that the exception is applied by major success
in judicial way, but it loses his efficiency in administrative way, being translated
in a breach against the Constitution and to the detriment of the consolidation
of the Social State of Law
