Particularly toward those who defend building an environmental constitutionalism on the basis of the new natural rights claiming the conditions of existence of transnational and globalized capitalism.Este artículo pretende cumplir con una triple perspectiva, a saber: En primer lugar, señalar los orígenes y sustentaciones de las tesis de algunos de los teóricos más emblemáticos del derecho natural racional, aportes muy asociados con los presupuestos que sentaron las bases conceptuales y prácticas del capitalismo de la Modernidad; En segundo lugar, a partir del punto de análisis anterior queremos mostrar de manera �pedagógica� los límites y contradicciones de las tesis fundadas en el derecho natural y , En tercer lugar, producir algunas conclusiones provisionales que nos permitan interrogarnos sobre el sentido social y político de los desarrollos que se vienen elaborando desde los análisis y perspectivas disímiles que realizan los juristas y académicos de hoy.
