Summary: This article aims to meet three perpectives, namely: First, identify the origins and sustainability of the thesis of some of the most emblematic theoretical rational natural law, contributions closely associated with the budgets that gave conceptual and practical bases of capitalist modernity; Secondly, from the point of the above analysis we show in a �teaching� the limits and contradictions of the theories based on the natural law and ;Thirdly, to produce some tentative conclusions that we can wonder about the political and social sense of the developments that are being prepared from dissimilar perspectives and analysis performed by today�s lawyers and academics. Particularly toward those who defend building an environmental constitutionalism on the basis of the new natural rights claiming the conditions of existence of transnational and globalized capitalism.
