The replacement of the old notion of absolute sovereign by a concept of interdependence between States was considered not only as an altruist and legitimate wish but as a necessity that could be realized through law. The objective of this article is to analyze the social reality in which the concepts of international public order and ius cogens emerged from the perspective of the process of their development in the International Law Commission and the 1969 Plenipotentiary Conference.
