Summary: This paper provides an appreciation of the existing theories about this topic, from the perspective of the General Constitutional Theory; and it is particularly concerned with the theories that the Colombian constituent has established in the National Normative Body. It has also been included comments about the concepts expressed by some constituents of the National Assembly, as well as by acknowledged authors, in order to draw conclusions about this study.
