Summary: By means of this article I intend to tackle the Institutional concepts of �property recovery� and �confiscation�, in order to elucidate if they permit asset forfeiture (sanction expressly prohibited by the Constitutional norm); concretely, in relation to the aspects of assets or equivalent values contained in the second section of the article 3 of Law 793 of 2002, and the third section of article 82 of Law 906 of 2004 (Criminal Procedure Code), respectively. Considering these concepts, and after reading he norms mentioned above, the following question emerged: Given the case that authorities could neither locate, confiscate or seize specific illegal assets, Could confiscation or property recovery be applicable as and equivalent to the assets or values not found, especially those illicitly acquired?. If true, this would be a confiscation act, sanction that was proscribed by Constitutional disposition (article 34).
