Our exercise is to provide certain coherence to a group of texts, especially those coming for Marx�s work, which can help us having a better understanding of nature and roles of the capitalist law. In fact, the intention becomes unavoidable in our days, since we are witnessing the collapse of the juridical positivism and the endless attempts of academic and political essays to �update,� in a modern manner, old ius naturalistic thesis based on or supported by contemporary scientific development which encourages us to forget important determinants of social-capitalist relationships. Accelerated dynamism of the so called knowledge society or network society forces the critical juridical sociology to be aware of the legal sense in this globalization world.El presente artículo tiene como propósito organizar y sistematizar algunas de las ideas y entendimientos elaborados por la ciencia social crítica, relativos o con la perspectiva de contribuir a una elaboración de una teoría sobre la naturaleza social y política del derecho moderno. Nuestro ejercicio ha consistido en darle alguna coherencia a un conjunto de textos, principalmente provenientes de la obra de Marx, que nos ayuden a tener mayor comprensión sobre la naturaleza y funciones del derecho capitalista. De hecho esta pretensión resulta insoslayable hoy en día en donde asistimos al colapso del positivismo jurídico y a los intentos inacabados de ensayos académicos y políticos que pretenden, de manera renovada, �actualizar� viejas tesis ius naturalistas, basadas o sustentadas en los desarrollos científicos contemporáneos, que nos convidan a olvidar los determinantes de fondo de las relaciones sociales capitalistas.
