The contested results in three southern states with each party claiming victory in Florida, Louisiana and South Caroline, the three former confederate states still dominated by republicans, resulted in two different set of electors sent to Washington. The Constitution provided no remedy for that situation, and the Congress was divided into a democratic House and a republican Senate. To solve that problem and decide the objections presented to the certificates and the final outcome of the election, both parties finally agreed to create a fifteen member Electoral Commission composed by five representatives, five senators and five Supreme Court justices.Las disputadas elecciones presidenciales de 1876 entre el republicano Rutherford Bitchard Hayes de Ohio y el demócrata Samuel Jones Tilden de Nueva York colocaron al país en una crisis político-constitucional y al borde de una nueva guerra civil. Los resultados electorales en tres estados sureños (Florida, Luisiana y Carolina del Sur, todos ellos integrantes de la antigua confederación y los únicos estados sureños aún bajo control de los republicanos), donde cada partido se atribuía la victoria en, trajo como consecuencia la remisión a Washington de dos listas diferentes de compromisarios. La Constitución no ofrecía solución alguna para este supuesto, y el Congreso se encontraba dividido entre una Cámara de Representantes en manos demócratas y un Senado bajo dominio republicano.
