AB  - In the past, under Montesquieu�s influence, the judge was seen as �la
bouche del la loi�; today, even in France, under the Théorie réaliste de
l�interprétation (TRI) � since there is no limit upon judges� interpretation � there
would be no limit upon their power in determining the legislative and
constitutional provisions. In this article the Author aims at defining the judiciary
power in the constitutional regime, where the central idea remains the limitation
of political authority as well as the protection of human rights.
