In the second part, the paper analyzes how the Constitution is loosing its normativ density, but this situation does not cut the popular demands of constitutional answers to the contemporary problems.Este trabajo, en su primera parte, propone un contexto general en el que evaluar la función de la Constitución. En este sentido destacan las transformaciones que pueden derivarse de los procesos de globalización, la fragmentación del proceso político, la sustitución del Estado social por la teoría de la regulación y, finalmente, la función contemporánea del Estado orientada a la tutela del riesgo.
