The richness of content and the breadth and scope of the work of Peter Häberle, as
well as recognition of his contribution to the ongoing development of constitutional
law have inspired this essay on the relationship between European Union and Globalization.
The orientation of their «knowledge interest» to the development of a
«common constitutional law,» his commitment to theoretical reflection as a tool for
construction of «a common culture on the right» and their awareness that the relationship
between law and legal culture is dominated by «the universality and the
criterion of justification act as guiding ideas of this work. From this perspective, the
analysis of the team formed by European Union and Globalization is redirected to
the idea of «fighting for the right» understood today as the key to development of a
great tradition in which the law is postulated as a factor regulating possible coexistence
of a fair and free. «On this basis the author reflects on the history and common
tradition of the state and constitutional law, on the present constitutional law and
the need to reinterpret classical concepts of constitutionalism, in particular the concept
of sovereignty. |
