The Judge just must resolve, following the rules of the procedure before ruled in the law of that process. When the Justice assumes evidential activity, it transforms partly and therefore he stops being Judge.ez. The evidential initiative just belongs to the parts in the process.El autor expone este trabajo en el 1er Encuentro de la Maestría de Derecho Procesal, de la Universidad Nacional de Rosario, Argentina, en el mes de agosto de 2009. Refl exiona acerca de la incumbencia probatoria, como tópico relevante dentro de la Teoría de la Prueba. Afi rma que la actividad probatoria es de absoluta incumbencia, obligación, función, facultad y derecho disponible, solamente de las partes, jamás descansa en la iniciativa del Juez. El Juez solo debe resolver siguiendo las reglas del procedimiento previamente reglado en la ley de aquel proceso. Cuando el Magistrado asume actividad probatoria, se transforma en parte y por tanto deja de ser Juez.
