In order to make this analysis first the labor situation of the women in the working world will be exposed. Secondly, the legal frame around the protection of the women workers who are in period of gestation will be described. Finally the article evaluates the impact that those legal developments have had in the working world.El presente artículo aborda el tema de la aplicación de precedente en materia de protección a la maternidad con el fin de analizar si dichos precedentes constituyen un aporte en la eliminación de las brechas de género que producen situaciones de discriminación a las mujeres gestantes que hacen parte del mundo laboral. Para realizar este análisis primero se expondrá de manera muy breve la situación laboral de la mujer en el mundo del trabajo; se expondrá el marco jurídico en torno a la protección de las mujeres trabajadoras que se encuentran en período de gestación y finalmente se pasará a revisar el impacto que han tenido esos desarrollos normativos en el mundo del trabajo.
