Summary: Study about incidence between the constitutional jurisdiction and the especial indigenous jurisdiction in reference to the autonomy and free determination of the indigenous peoples, in the context of the cultural interactionism: cultural integrationism and cultural pluralism, that is the substrate of the legal monism and pluralism. The text presents the antecedents and the actual situation of the protection of the indigenous jurisdiction and refers the most important jurisprudential position respect the indigenous autonomy, and the reciprocal incidence are the diversity, identity, ethnical cosmovision and the respect by the fundamental principles and rights.
