However, it`s just since the 1996 wipo Copyright Treaty that the tpms have been clearly stated and legally backed up. The broad provision contained in the aforementioned treaty has been fine-tuned by the local statutes of the signatory countries. Regarding the definition of tpm, the following elements could be found in the local laws: product, device, component; the tpm shall be applied on a copyright protected work; the tpm shall be applied to prevent, inhibit or impair the infraction of the copyright in the work or to exercise access control thereof; the effectiveness; the application of the measure by a legally qualified person. Standing to sue, the ways to infringe a legally protected tpm, the criminal and civil liability arisen from an infraction and the liability limitations have been coped as well by the local laws. This paper focuses on the meaning of the abovementioned complex elements, always being aided by the case law and the commentaries of the experts on the field. It embodies three sections: the study of the practical function of the tpm and the legislative antecedents of the regulation thereof; the meaning of tpm and the conditions that shall meet in order to be legally protected; ways to infringe a legally protected tpm and the liability statutory limitations.
