It focuses on the regulation of the main issues related to immigration: border control and regulation of migration flows, the conditions for acquiring citizenship and the treatment of refugees and minorities. It underlines the influence of the colonial experience in current migration policies, as well as the gradual convergence of these policies in Europe, characterized by increasingly restricting the entry of immigrants, the fight against the irregularity and at least partial integration of immigrants with legal residence. For the author, communitarization of these subjects in the recent past strengthens a utilitarian view of immigration and an obsession with security that restricts the rights of immigrants, especially refugees and asylum seekers. By the other side, there is a jurisprudential tendency to protect their fundamental rights and equate their rights in the workplace.
