This Constitution did not achieve real recognition, neither had real force. It was lacked of political legitimacy because of ideological reasons and for lacking of national feeling. Likewise, this constitution did not answer to the needs and aspirations of Peru. For those reasons, its norms were ephemeral and its institutions were not reflected in the historical Constitution of Peru.El presente trabajo estudia el proyecto político de Simón Bolívar en el Perú y la elaboración de la Constitución de 1826, denominada Constitución Vitalicia. Dicha Constitución fue copia de la Constitución del Estado Boliviano, que a la postre fue impuesta por el ¿libertador¿ Bolívar, a los colegios electorales, quienes simplemente, obedecieron la consigna. Esta Constitución no logró reconocimiento verdadero, tampoco tuvo real vigencia. Carecía de legitimidad política por razones ideológicas y por falta de sentimiento nacional. Asimismo, no respondía a las necesidades y aspiraciones del Perú.
