Summary: This work analyzes the IV Title of the Statutory Labor Law, from a sort perspective, referred to Maternity and family, as an expression of protection policy to workers biological and social reproduction, proposing to reconstruct the policy formation process, to identify the reach and limitations of its content and to determine sorts slants. For the policy´s formation process reconstruction I have focused interviews to five key informants, relevant actors, in that process, which were analysed through speech analysis techniques. The IV Title analysis of Labor Law, was done by means of text content analysis.Interests of class and economic, and value of sorts, which entered game in the policy´s elaboration, were identified, with a prevailing interest to protect women´s productive insertion. The biological and social production reach is limited, when resting its responsibilities and protection measures to maternity and woman–mother. The father or man worker is excluded from family responsibilities, except in the day-care centers use. The protection measures, are based on the woman worker´s temporary separation, from the work atmosphere, to protect herself from risks or dedicate herself to the care of her son, more than to modify the dangerous working conditions. A feminine sort on the protection of workers reproductive health, has the effect to limit women access and permanence to the job and to limit the man worker as beneficiary. An approach which integrates women and men´s participation in the social reproduction and in the productive work will allow to surpass the sorts slants in the labor health policies.
